Guardianship and Conservatorship Lawyer in Utah

Filing for Conservatorship or Guardianship in Utah

If you have a minor or parent that is reaching an age where they can no longer take care of themselves you may want to file for a guardianship and conservatorship in Utah. The lawyers at Arnold, Wadsworth & Coggins can help you through the process and through the court system in order to get the conservatorship approved, or the guardianship.

A guardian is a person appointed by the court or institution appointed by a court to make decisions about the care of another, who is called a “ward” and who is determined to be incapacitated. A conservator is a person or institution appointed by the court to manage the property and financial affairs of a ward after the court has decided that the person is incapacitated. The conservator and guardian as assigned by the court can be the same person. There are a lot obligations that the conservator and guardian come under in order to effectively represent the estate of the incapacitated person. If a conservator is not assigned the guardian will have some of the responsibilities of a conservator under Utah law and cod section 75.
