Annulment and Divorce in Utah

Can you file for an Annulment and in the alternative a divorce in Utah? The answer is YES. Utah Code Annotated 30-1-17.4 states:

“Nothing herein shall be construed to prevent the filing of an action requesting an annulment or a divorce as alternative relief.”

So what does this mean? This mean that if you believe that you have cause to file for annulment then you can also request in the alternative that you can be granted a divorce. This is important because this saves you from paying another filing fee, and re-serving the other party with a petition for divorce. This can also become helpful to an attorney if the divorce lawyer is really trying to get an annulment. This will save the attorney time from telling their client that the whole process has to start all over. The client never wants to hear that the annulment or divorce action has to start all over.
