I am sure that a lot people have been reading the news about Tom Cruise and his divorce from Katie Holmes. What has been interesting from a legal perspective is how fast it got done behind closed doors. It seems that Katie Holmes got everything she asked for. Some people seem to wonder how she was able to get so much done so quickly. From a divorce standpoint one thing that has stood out to me is the religion factor of the divorce. For example, did Tom Cruise really want his religion open and for every one to observe in divorce court. To me that was something he was not willing to do. Tom Cruise did not want his religion on trial. It seems to me that he did not want his religion on trial and therefore he simply gave custody of the child to Katie Holmes.
What can be learned from the Tom Cruise Divorce? One thing is that your personal life may be under a microscope including your religion. I am sure there are things that Katie Holmes knows that Tom Cruise does not want out in public documents. The interesting thing to me is that Katie Holmes should have known all of these things when she married Tom Cruise and therefore in my mind waived any arguments of how “weird” or “crazy” his religion is. Another thing to be learned is that your divorce in Utah can be settled outside of court. You and your spouse (and even your divorce lawyers) can meet behind closed doors and work out a settlement.
