Can you file for an Annulment and in the alternative a divorce in Utah? The answer is YES. Utah Code Annotated 30-1-17.4 states:
“Nothing herein shall be construed to prevent the filing of an action requesting an annulment or a divorce as alternative relief.”
So what does this mean? This mean that if you believe that you have cause to file for annulment then you can also request in the alternative that you can be granted a divorce. This is important because this saves you from paying another filing fee, and re-serving the other party with a petition for divorce.
